1. Acceptance of Terms

By downloading, installing, or using the ShrinkAI mobile application ("App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, please do not use the App.

These Terms constitute a legally binding agreement between you and Lucid Studios LLC ("ShrinkAI," "we," "our," or "us").

2. Description of Service

ShrinkAI is an AI-powered calorie tracking and nutrition management application that helps users:

• Track daily food intake and calories
• Analyze food images using AI technology
• Monitor macronutrients (protein, carbs, fats)
• Set and track weight management goals
• Integrate with Apple Health for fitness data
• Scan product barcodes for nutrition information

3. Account Registration and Security

Account Creation

• You may use ShrinkAI with Apple Sign-In or Google Sign-In
• You must be at least 13 years old to use the App
• You must provide accurate and complete information

Account Security

• You are responsible for maintaining the security of your account
• You must notify us immediately of any unauthorized use
• We are not liable for any loss resulting from unauthorized account access

4. Subscriptions and Payments

Subscription Plans

ShrinkAI offers the following subscription options:

• Monthly Plan: $9.99/month
• Yearly Plan: $29.99/year (includes 3-day free trial)

Payment Terms

• Subscriptions are processed through Apple's In-App Purchase system
• Payment will be charged to your Apple ID account upon purchase confirmation
• Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period
• Your account will be charged for renewal within 24 hours prior to the end of the current period

Free Trial

• Yearly subscriptions include a 3-day free trial
• You will not be charged during the trial period
• You can cancel anytime during the trial without charge
• If you don't cancel, you'll be charged the full subscription price after the trial ends

Cancellation and Refunds

• You can cancel your subscription anytime through your Apple ID account settings
• Cancellation takes effect at the end of the current billing period
• Refunds are handled by Apple according to their refund policy
• We do not provide refunds directly

5. Acceptable Use

You Agree NOT To:

• Use the App for any illegal or unauthorized purpose
• Violate any laws in your jurisdiction
• Attempt to hack, reverse engineer, or compromise the App
• Upload malicious code or viruses
• Harass, abuse, or harm other users
• Impersonate any person or entity
• Collect or harvest data from other users
• Use automated systems or bots to access the App

6. Medical Disclaimer

ShrinkAI is a nutrition tracking tool and is not intended to:

• Diagnose, treat, cure, or prevent any disease or medical condition
• Replace professional medical advice, diagnosis, or treatment
• Be used as a substitute for consultations with qualified healthcare providers

Always consult with a physician or qualified healthcare provider before:

• Starting any diet or weight loss program
• Making significant changes to your nutrition
• If you have any medical conditions or concerns

The calorie and nutrition information provided by ShrinkAI is estimated and may not be 100% accurate. Use it as a general guide, not as exact measurements.

7. AI Analysis Accuracy

ShrinkAI uses artificial intelligence to analyze food images and estimate nutritional content. While we strive for accuracy:

• AI analysis is an estimate, not an exact measurement
• Accuracy depends on image quality, lighting, and food visibility
• Results may vary and should be verified when precision is critical
• We do not guarantee 100% accuracy of AI-generated nutrition data
• You are responsible for verifying nutrition information when accuracy is important

8. Intellectual Property

Our Content

All content, features, and functionality of the App, including but not limited to:

• Text, graphics, logos, icons, images
• Software code and algorithms
• AI models and analysis systems
• Design and layout

are owned by ShrinkAI and protected by copyright, trademark, and other intellectual property laws.

Your Content

• You retain ownership of food images and data you upload
• You grant us a license to use your content solely to provide the App's services
• We may use anonymized data for improving our AI models

9. Third-Party Services

ShrinkAI integrates with third-party services:

• Firebase (Google) - Cloud services
• RevenueCat - Subscription management
• OpenAI - AI analysis
• Apple HealthKit - Health data integration
• OpenFoodFacts - Barcode nutrition database

Your use of these services is subject to their respective terms and privacy policies.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• ShrinkAI is provided "AS IS" and "AS AVAILABLE" without warranties of any kind
• We do not guarantee the App will be error-free, secure, or uninterrupted
• We are not liable for any damages arising from your use of the App
• Our total liability shall not exceed the amount you paid for your subscription
• We are not responsible for any health outcomes or weight changes

11. Indemnification

You agree to indemnify and hold harmless ShrinkAI, its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any rights of another party
• Any health or medical outcomes related to your use of the App

12. Termination

We reserve the right to:

• Suspend or terminate your account at any time for any reason
• Refuse service to anyone without notice
• Remove or modify any content at our discretion

You may terminate your account at any time by:

• Canceling your subscription through Apple ID settings
• Deleting the App from your device
• Contacting us to request account deletion

13. Changes to Terms

We may modify these Terms at any time. Changes will be effective when posted in the App. Your continued use after changes constitutes acceptance of the modified Terms.

We will notify you of material changes through:

• In-app notifications
• Email (if provided)
• Updated "Last Updated" date

14. Governing Law

These Terms are governed by and construed in accordance with the laws of the United States and the State of California, without regard to conflict of law principles.
